ADR Processes

At Daniels Mediation & ADR, we use different Alternative Dispute Resolution (ADR) processes tailored to the needs of families, organizations, and communities. Each process is designed to reduce conflict, save time, and achieve fair outcomes outside traditional litigation.

Mediation

A voluntary and confidential process where a neutral mediator facilitates dialogue between parties. The focus is on mutual understanding, collaboration, and reaching agreements that work for everyone.

Arbitration

A structured process where a neutral arbitrator listens to both sides and makes a binding decision. Arbitration offers speed, privacy, and cost-effective resolution compared to lengthy court trials.

Med-Arb (Mediation–Arbitration)

A hybrid process that begins with mediation and, if unresolved, shifts into arbitration. This approach allows parties to attempt cooperation while guaranteeing closure if consensus is not reached.

Conciliation

Similar to mediation but with the conciliator playing a more active role in suggesting solutions. This is especially useful when parties struggle to generate options on their own.

Early Neutral Evaluation (ENE)

A process where a neutral expert assesses the strengths and weaknesses of each side’s case early on. This helps parties make informed decisions and encourages settlement.

Mini-Trial

A structured, informal presentation of each side’s position before decision-makers. The goal is to promote negotiation and settlement without resorting to a full court trial.
